Tax, legal & title
Freehold, leasehold, strata and commercial titles
Quick answerFreehold has no expiry and resells easily; 99-year leasehold must be renewed with the state for a premium, and a short remaining lease limits bank loans. Condos have strata titles, with common areas run by a JMB / MC. Many serviced apartments sit on commercial land, which can mean different utility tariffs, loan and tax treatment. Have a lawyer check the title type, remaining lease and restrictions.
30-second summary
- Freehold: No expiry; easier resale
- Leasehold: Usually 99 years; renewal needed
- Strata: Condos / strata landed; JMB → MC
- Commercial title: Common for serviced apartments; tariffs may be higher
- Remaining lease: Too short can affect loans
- Foreigners: Mostly strata condos or gated strata landed
Freehold vs leasehold
| Freehold | 99-year leasehold | |
|---|---|---|
| Term | None | Usually 99 years (also 30, 60) |
| Transfer | Generally simpler | May need state consent (per title) |
| On expiry | — | Apply to renew and pay a premium |
| Bank loans | Easier | Margin and tenure may be limited when the lease is short |
| Price | Usually higher | Usually lower |
Johor has many freehold projects, but Iskandar Puteri and some newer zones have plenty of 99-year leaseholds. Decide by how long you'll hold and who you'll sell to.
Strata titles and management
- Condos and gated strata landed homes have strata titles, applied for by the developer after completion.
- The developer manages at first, then a JMB (Joint Management Body) is formed, becoming an MC (Management Corporation) once strata titles issue, under the Strata Management Act 2013.
- Owners pay a maintenance fee and a sinking fund (generally 10% of the maintenance fee).
Serviced apartments on commercial land
- Many JB serviced apartments sit on commercial-use land.
- Possible effects: commercial utility tariffs, higher assessment, different bank terms, and first-home relief / stamp duty treatment to be confirmed case by case.
- Upside: usually central, near transport, with full facilities.
Check before buying subsale
- Title type (freehold / leasehold) and remaining lease
- Restrictions in interest (e.g. not transferable to non-Bumi / foreigners)
- Whether the strata title has been issued
- Charges, caveats or prohibitions
- Land use: residential or commercial
- Any arrears in maintenance fees

Frequently asked questions
Freehold or 99-year leasehold?
Freehold has no expiry and resells more easily, usually at a higher price; leasehold is cheaper but a short remaining lease affects loans and resale. Decide by your holding plan.
What happens when a 99-year lease expires?
You apply to the state to renew and pay a premium set by the state.
How is a serviced apartment different from a condo?
Many serviced apartments are on commercial land, so utilities and assessment may be at commercial rates and loans and taxes may be treated differently.
Which titles do foreigners buy?
In Johor foreigners mostly buy strata condos or gated strata landed homes, freehold or leasehold, subject to the floor and state consent.
