30-second summary
- Bumi quota: Generally about 40% of new Johor projects
- Bumi discount: Generally about 15% (new launches)
- Non-Bumi / foreigners: Cannot buy unreleased Bumi units
- Release: Needs state approval, conditions and fees
- Malay Reserve: Malays only
- How to check: Title restriction in interest and a land search
Why do Bumi units exist?
To raise home ownership among Bumiputera (Malays, Orang Asli and others), Malaysian states require new housing projects to reserve a share of units for Bumiputera buyers at a discount. Johor generally applies about a 40% quota and about a 15% discount (varies by project and price). That's why some units in the same tower aren't available to you.
Three different restrictions
| Bumi unit (Bumi lot) | Malay Reserve Land | Foreigner rules | |
|---|---|---|---|
| Who can buy | Bumiputera | Malays only | Malaysian citizens (and qualifying foreigners) |
| Can it change? | Release possible (approval needed) | Generally no | Foreigners: floor + consent |
| How to spot it | SPA / developer list; title restriction | Title states Malay Reservation | State rules |
| Risk for non-Bumi | Transfer can't be registered | Transaction void | — |
What is "release" of a Bumi unit?
- If Bumi units in a new project stay unsold for long, the developer can apply to the state to release them to non-Bumiputera, usually after a marketing period and on payment of fees.
- For a subsale Bumi unit, an owner selling to a non-Bumiputera also needs approval, which is not guaranteed and can take a long time.
- As a non-Bumi buyer, confirm the release is formally approved in writing — not just "the developer will handle it".
How to read the title
- Have your lawyer run a land search
- Check the restriction in interest (sekatan kepentingan), e.g. "not transferable to non-Bumiputera"
- Check whether it is Malay Reserve Land
- New launch: check the SPA schedule and the developer's Bumi / non-Bumi unit list
- Subsale: ask the seller for a title copy and the previous SPA
Effect on price and resale
Because fewer buyers can purchase Bumi units, their resale market is narrower and prices can be lower than non-Bumi units in the same block. For non-Bumi buyers, non-Bumi units have a wider resale market — any Malaysian can buy, and above the floor you can sell to foreigners too.
